What is an Exclusive Buyer's Agent?
Initially upon first contact with a Broker or Agent you should not assume that any real estate broker or salesperson represents you, unless you agree to engage a real estate licensee in an authorized brokerage relationship, either as a single agent (Seller's Agent or Buyer's Agent) or as a Transaction Broker.  The purpose of the agency disclosure is to acknowledge that the disclosure occurred and that the consumer has been informed of the various agency relationships which are available in a real estate transaction.
In the State of Florida there are three types of agents, Seller's agents, Buyer's agents, and Transaction Brokers. The Seller's agent acts on behalf of the Seller.  Transaction Brokers do not represent either the Buyer or the Seller.  Transaction Brokers just facilitate a transaction.  Both of these relationships may negotiate with Buyers (for properties that they have listed) but neither one represents the buyer.  Both Seller's agents and Transaction Brokers seek properties to list and sell.  If a Seller's agent is selling a property that their company listed and a Buyer is interested in their listing, and the Buyer begins negotiations with the firm, the Buyer will not have representation by that firm.  The firm must either act on behalf of the Seller or transition to a Transaction Broker where neither party is represented. 
It is J.A.F. Appraisals & Real Estate's policy to act an Exclusive Buyer's Agent 
when a relationship is formed with a client. 
J.A.F. Appraisals & Real Estate does not accept listings, therefore,
there is never a conflict of interest and the Buyer has full representation by our firm.
What duties and obligations does a single agent owe to their client when a relationship is formed?
As an Exclusive Buyer's Agent J.A.F. Appraisals & Real Estate and the licensees of this company owe to you the following duties:
A duty of honesty & fair dealing;
The fiduciary duties of loyalty, confidentiality, obedience, full disclosure, accounting for all funds, and the duty to use skill, care, and diligence in the transaction.
All offers and counteroffers are to be presented in a timely manner, unless a party has previously directed the licensee otherwise in writing.
When acting as a single agent it is the agent's duty to disclose all facts known to the agent which materially affect the value of the residential real property.  Full disclosure involves any information which is not known to, or readily observable by, the parties in a residential real property transaction.
